purchase & deposit terms

These Purchase & Deposit Terms (“Terms”) govern deposits, purchases, and orders placed with TuffTide Marine, LLC (“TuffTide,” “Company,” “we,” “our,” or “us”).
By placing a deposit or submitting payment toward a boat or related product, you agree to these Terms.
1. Deposit Requirement
To reserve a production slot, configuration, or build position, a deposit may be required.
Deposits:
Secure a place in the production queue
Initiate design, material sourcing, and scheduling
May be required before final specifications are confirmed
2. Non-Refundable Deposits
All deposits are non-refundable unless otherwise agreed in writing by TuffTide Marine.
By placing a deposit, you acknowledge and agree that:
Production planning and materials procurement may begin immediately
The deposit compensates TuffTide for reserving capacity and initiating work
Deposits are not contingent upon financing approval, personal circumstances, or change of preference
Chargebacks or payment disputes initiated after a deposit is placed may be subject to recovery efforts and associated fees.
3. Pricing & Specifications
All pricing, specifications, and features are subject to change prior to final written purchase agreement.
Website descriptions, renderings, and marketing materials are for illustrative purposes only and do not constitute binding specifications.
Final specifications will be confirmed in writing prior to completion.
4. Production Timeline
Estimated build times are estimates only.
TuffTide Marine does not guarantee specific completion or delivery dates.
Production schedules may be affected by:
Material availability
Supply chain disruption
Labor availability
Customization changes
Weather conditions
Regulatory requirements
Force majeure events
Delays shall not constitute grounds for cancellation or refund of deposit.
5. Final Payment
Full payment must be received prior to delivery or release of the boat.
Failure to complete payment within the agreed timeframe may result in:
Forfeiture of deposit
Cancellation of order
Resale of the boat to another customer
6. Delivery & Pickup
Unless otherwise agreed in writing:
Boats must be picked up at TuffTide Marine’s facility in Enfield, Connecticut.
Risk of loss transfers to the customer upon pickup or transfer to third-party carrier.
If shipping is arranged:
All freight, insurance, crating, and transportation costs are the responsibility of the purchaser.
TuffTide is not responsible for damage occurring during third-party transport.
7. Inspection & Acceptance
Customer is responsible for inspecting the boat upon delivery or pickup.
Any visible damage or issues must be documented prior to leaving the facility or prior to signing for freight delivery.
Failure to document issues at delivery constitutes acceptance.
8. Custom Orders
Custom builds, modifications, or special configurations may not be eligible for cancellation once production has begun.
Changes requested after confirmation may result in:
Additional charges
Extended timelines
Revised delivery estimates
9. Warranty
Any warranty provided by TuffTide Marine will be outlined in a separate written Warranty Policy.
Except as expressly stated in a written warranty, no additional warranties are provided.
10. Limitation of Liability
To the fullest extent permitted by law, TuffTide Marine shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:
Purchase
Delay
Use or inability to use the boat
Transportation
Third-party services
Total liability shall not exceed the amount actually paid by the purchaser for the boat hull.
11. Cancellation by TuffTide
TuffTide Marine reserves the right to cancel an order and refund any payments received if:
The purchaser violates these Terms
Fraud is suspected
Payment cannot be verified
Production becomes commercially impractical
12. Governing Law
These Terms are governed by the laws of the State of Connecticut.
Any dispute shall be brought exclusively in the state or federal courts located in Connecticut.
13. Entire Agreement
These Terms, together with any written purchase agreement and warranty policy, constitute the entire agreement between the parties regarding deposits and purchases.
